Examify is owned and operated by On Media Services Enterprise ("On Media Services Enterprise", "we", "us", or "our"). These Terms & Conditions govern your access to and use of the Examify website, applications, learning platform, subscription services, educational content, AI-powered features, payment services, and related products and services.
By accessing, browsing, registering for, subscribing to, or otherwise using Examify, you agree to be bound by these Terms of Service, our Privacy Policy, Refund and Cancellation Policy, Acceptable Use Policy, and any other policies expressly incorporated into these Terms. If you do not agree with these Terms, you must not use the Service.
Examify is an online education and examination-preparation platform designed to help learners prepare for academic, professional, language, and standardised examinations. Examify may provide preparation resources and tools for examinations including IELTS, SAT, CCNA, and other examinations introduced on the platform from time to time. Examify is an independent preparation platform unless expressly stated otherwise and is not an official examination provider.
You must be legally capable of entering into a binding agreement under the laws applicable to you to use Examify independently. Where a user is below the applicable legal age, use of the platform may require the involvement or consent of a parent or legal guardian. Parents or guardians who permit a minor to use Examify are responsible for supervising such use where required by applicable law.
Certain Examify features require you to create an account. You agree to provide accurate, current, and complete information and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. You must notify Examify promptly if you suspect unauthorised access to your account. Account credentials must not be sold, transferred, or shared in violation of your subscription plan or these Terms.
Examify may provide practice questions, topic-based learning, mock examinations, timed tests, answer explanations, AI-assisted feedback, study plans, performance analytics, progress tracking, personalised recommendations, writing feedback, speaking practice, study-coaching tools, revision resources, dashboards, and other educational features. Features and availability may vary by subscription plan, examination, geographic location, or account type.
Examify may introduce, modify, suspend, limit, or discontinue features, examinations, content, subscription benefits, usage limits, or other aspects of the Service from time to time. We may make such changes for operational, technical, educational, security, legal, or commercial reasons. Where required by applicable law, material changes affecting paid services will be communicated appropriately.
Examify may use artificial intelligence and machine-learning technologies to generate questions, explanations, recommendations, study plans, feedback, assessments, and other educational content. AI-generated content may contain errors, omissions, outdated information, or inaccurate recommendations. AI output is provided for educational and preparation purposes only and should not automatically be treated as authoritative. Users should verify important information against official examination materials and recognised sources where appropriate.
Examify may analyse your answers, study activity, performance, and other learning information to provide recommendations, identify potential weaknesses, suggest revision topics, estimate performance, or personalise your learning experience. These recommendations are estimates and are not guarantees of examination results. Automated analysis does not constitute an official academic, admissions, employment, certification, immigration, or examination decision.
Scores, grades, bands, percentages, rankings, predictions, analytics, and other performance indicators generated by Examify are practice or estimated results only. They are not official examination results and may not exactly reflect the scoring methodology used by an examination provider. Examify does not guarantee that using the Service will result in a particular examination score, grade, band, certification, admission, employment opportunity, or other outcome.
Examify is an educational preparation service and not a substitute for an official examination provider, official examination materials, a qualified teacher, tutor, counsellor, or other professional adviser. We make reasonable efforts to provide useful and relevant content but do not guarantee that all content will be error-free, complete, current, or representative of questions appearing on a future examination.
Examify may reference examination names, certification names, trademarks, logos, specifications, or other materials owned by third parties. Unless expressly stated otherwise, Examify is not affiliated with, endorsed by, sponsored by, or administered by the relevant examination provider. Third-party trademarks remain the property of their respective owners.
Examify may offer free and paid subscription plans. Free plans may provide access to selected features, questions, analytics, or learning resources. Paid plans may provide additional questions, mock examinations, advanced analytics, study coaching, writing feedback, speaking simulation, increased usage limits, or other premium features. The features and limitations applicable to each plan are those displayed on the Examify platform at the time of subscription.
When you purchase a paid subscription, you agree to pay the applicable fee displayed at the time of purchase. Depending on the plan, subscriptions may automatically renew for successive billing periods unless cancelled before renewal. You authorise Examify and its authorised payment providers to process applicable subscription charges, taxes, and other amounts properly due under your selected plan.
Payments may be processed through third-party payment providers. Examify may not store complete payment-card information where payment processing is handled by an authorised third-party provider. Your use of a third-party payment service may also be subject to that provider’s terms and privacy policy. You are responsible for ensuring that your payment information remains accurate and valid.
Examify may offer prices in different currencies depending on your location, payment method, or applicable payment infrastructure. The final amount charged may be affected by applicable taxes, currency conversion, exchange-rate differences, bank charges, or payment-provider charges. Examify reserves the right to change pricing from time to time, subject to applicable law and any required notice.
You may cancel a recurring subscription through the applicable account, billing, or payment-management process provided by Examify or the relevant payment provider. Cancellation generally prevents future renewal but does not automatically entitle you to a refund for a billing period that has already started, except where required by applicable law or provided under the applicable Refund and Cancellation Policy.
Refund eligibility is governed by the Examify Refund and Cancellation Policy and applicable consumer-protection laws. Unless otherwise stated or legally required, cancellation of a subscription does not automatically result in a refund for unused time remaining in a paid billing period. Examify may consider refund requests based on the circumstances of each case and the applicable refund policy.
If you believe you have been incorrectly charged, you should contact Examify through its official support channel before initiating a payment dispute or chargeback where reasonably possible. Examify may suspend access to paid features while investigating fraudulent, abusive, or unjustified payment disputes. Nothing in these Terms limits any lawful consumer or payment rights.
Examify and its licensors retain all rights, title, and interest in the platform and its proprietary materials, including software, source code, user interfaces, branding, logos, question banks, original questions, explanations, study plans, graphics, audio, video, databases, analytics systems, AI systems, and other original content. Except as expressly permitted by these Terms, you may not reproduce, distribute, sell, license, publish, modify, reverse engineer, scrape, extract, or commercially exploit Examify proprietary materials.
Subject to these Terms and your applicable subscription, Examify grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, lawful, non-commercial educational purposes. This licence does not transfer ownership of Examify content or technology to you.
You must not resell Examify access, share premium accounts in violation of applicable plan rules, copy or reproduce substantial portions of the question bank, systematically download or extract platform content, create a competing database using Examify materials, remove proprietary notices, or use Examify content to train, fine-tune, or develop a competing artificial-intelligence or educational system without prior written permission.
Certain Examify features may allow users to submit questions, written answers, speaking responses, recordings, feedback, or other content. You retain ownership of User Content to the extent you legally own it. By submitting User Content, you grant Examify the limited rights necessary to host, process, analyse, reproduce, and use that content to provide, operate, maintain, improve, secure, and support the Service, subject to the Examify Privacy Policy and applicable law.
You agree not to use Examify to violate applicable laws, infringe third-party rights, gain unauthorised access to accounts or systems, interfere with platform operations, introduce malware or harmful code, circumvent security controls, abuse automated systems, scrape or harvest content without permission, upload unlawful or harmful material, manipulate performance statistics, or otherwise misuse the Service.
Examify is intended to support legitimate learning and examination preparation. You must not use Examify to facilitate cheating during a live, proctored, or otherwise restricted examination. You are responsible for complying with the rules of the examination provider, school, university, employer, certification body, or other institution relevant to your examination.
You must not attempt to compromise or interfere with Examify security systems. Prohibited activities include attempting to access restricted systems, obtaining another user’s credentials, bypassing authentication controls, conducting unauthorised vulnerability testing, introducing malicious software, overloading platform infrastructure, or exploiting vulnerabilities without permission.
Examify aims to provide reliable access to the Service but does not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to maintenance, software updates, security incidents, infrastructure failures, internet or telecommunications failures, third-party service interruptions, force majeure events, or other circumstances beyond Examify’s reasonable control.
Examify may integrate with third-party services, including payment processors, hosting providers, analytics services, authentication providers, artificial-intelligence providers, email services, and other technology providers. Examify is not responsible for the independent operation, availability, policies, or practices of third-party services.
The Service may contain links to websites, applications, or resources operated by third parties. Such links are provided for convenience and do not necessarily constitute an endorsement. Examify does not control and is not responsible for the availability, accuracy, security, content, or practices of third-party websites or services.
Examify may collect and process personal information, account information, payment information, learning activity, answers, examination results, performance data, technical information, and other information necessary to provide and improve the Service. The collection, use, storage, and processing of personal information is governed by the Examify Privacy Policy and applicable data-protection laws.
Examify may collect and analyse information about your use of the platform, including questions attempted, answers submitted, topics studied, mock-examination results, study history, progress, and other learning activity. Such information may be used to provide personalised learning, analytics, recommendations, security, support, service improvement, and other lawful business functions as described in the Privacy Policy.
If you believe that material available through Examify infringes your copyright or other intellectual-property rights, you should contact Examify through the official contact channel and provide sufficient information to identify the allegedly infringed work, the disputed material, its location, your contact details, evidence of ownership or authority to act, and any other information reasonably necessary to investigate the complaint.
If you provide Examify with suggestions, ideas, recommendations, feature requests, reviews, or other feedback, Examify may use that feedback to improve its products and services without restriction or compensation, subject to applicable law and any privacy obligations that apply to the information provided.
Examify may suspend or terminate your account or restrict access to the Service where you materially breach these Terms, engage in fraud, misuse the platform, compromise platform security, infringe intellectual-property rights, engage in unlawful or abusive conduct, fail to satisfy payment obligations, or where suspension is reasonably necessary to protect Examify, its users, or its infrastructure.
Upon termination, your right to access the Service and premium features may end immediately. Certain information may be retained where required for legal, accounting, security, fraud-prevention, regulatory, or legitimate business purposes. Provisions that by their nature should survive termination, including intellectual-property rights, disclaimers, limitations of liability, indemnification, and dispute-related provisions, will continue to apply.
To the maximum extent permitted by applicable law, Examify provides the Service on an “as is” and “as available” basis. Examify does not guarantee that the Service will always be available, error-free, secure, accurate, complete, current, or suitable for every learner. Examify does not guarantee examination success, a particular score, grade, band, certification, admission, employment opportunity, or other outcome.
To the maximum extent permitted by applicable law, Examify and its officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service. Where legally permitted, Examify’s total aggregate liability arising from your use of the Service will not exceed the greater of the amount you paid to Examify for the Service during the twelve months preceding the event giving rise to the claim or USD $100. Nothing in these Terms excludes liability that cannot legally be excluded.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Examify, its affiliates, officers, employees, contractors, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from your violation of these Terms, misuse of the Service, violation of applicable law, infringement of third-party rights, or User Content that you submit where applicable.
Examify will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, government actions, internet failures, power outages, cyberattacks, telecommunications failures, third-party infrastructure failures, epidemics, pandemics, or other events outside reasonable control.
Examify may update these Terms from time to time. Where changes are material, Examify may provide reasonable notice through the platform, email, or another appropriate method where required by applicable law. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.
These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the legal entity operating Examify is established, subject to any mandatory consumer-protection or other applicable laws that cannot lawfully be excluded. The applicable jurisdiction and legal entity should be identified in the final published version of these Terms.
If you have a dispute with Examify, you agree to first attempt to resolve the matter informally by contacting Examify through its official support or contact channel. If the dispute cannot be resolved informally, it may be referred to the courts or other dispute-resolution mechanism applicable under the governing law. Nothing in this section prevents a consumer from exercising mandatory statutory rights.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
A failure or delay by Examify to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision or any other provision in the future.
You may not assign or transfer your rights or obligations under these Terms without Examify’s prior written consent. Examify may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, corporate reorganisation, or similar transaction, subject to applicable law.
These Terms, together with the Examify Privacy Policy, Refund and Cancellation Policy, Acceptable Use Policy, subscription terms, and other policies expressly incorporated into these Terms, constitute the entire agreement between you and Examify concerning your use of the Service and supersede prior agreements or understandings concerning the same subject matter.
